The firm represented the defendant in the district court patent action and the petitioner in a related Inter Partes Review. The Court adjudged the asserted claims indefinite and the PTAB found the challenged claims invalid. The Federal Circuit affirmed both decisions.

McGeary Cukor LLC represents the Petitioner in Sandbox Medical LLC v. Neotech Products, Inc., IPR2019-00246. The Patent Trial and Appeal Board instituted an Inter Partes Review of all claims in U.S. Patent No. 6,958,050, entitled “Nasal/Oral Aspiration Device,” on all grounds raised in the Petition. The patent has 10 claims relating to a medical suctioning device and is also the subject of a related district court litigation. The firm filed the petition prior to November 13, 2018; therefore, the Board will apply the broadest reasonable interpretation claim construction standard for this IPR.
